A Message to Friends of Cliven Bundy and the BLM

Cliven Bundy and his family are kind and wonderful people. It is hard to understand that he truly does not believe that he is doing anything wrong. The fact that Mr. Bundy illegally grazes his cattle in Gold Butte is all a part of the culture that he believes in and perpetuates. Mr. Bundy does not consider the United States of America to have any jurisdiction over him. When he calls Gold Butte his ranch, he actually deems it so.

Mr. Bundy’s quote, ”Federal rangers have no jurisdiction or authority, no policing power or arresting power.”, is indicative of how he feels about federal laws and those that enforce them. It is how he feels about citizens that support BLM and enforcing laws that require Mr. Bundy to remove his cattle from Gold Butte.

Allotments in the Gold Butte region have been closed to grazing since 1994. Families with legal grazing rights in the Gold Butte area were compensated to relinquish those grazing rights. Mr. Bundy and others that believe in the “state’s rights” theory reject the federal laws that no longer allow grazing in Gold Butte. Not believing in a law does not give you permission to disobey the law.

Fifteen years is a long time to wait for the grazing laws affecting Gold Butte to be upheld. Gold Butte and the citizens who love and appreciate the area deserve better. Mr. Bundy has drawn a line around Gold Butte and has declared it his compound. He is ready to defend his compound and hopes it will not come to using force. My hope is that all the rational people will see Mr. Bundy for who he truly is. His irrational and unrealistic thought processes have been in charge for too long.

Please gently and kindly remove the illegal cattle from Gold Butte. Mr. Bundy is not able to follow the law and he will now have to pay for it.

      I thank Terri also, as I have been responding the same way for the last 10 or so Tea Party updates. However, I received lots of nastiness from fellow Tea Party members when declaring another perspective. What the Bundy’s did was to escalate a matter that could probably have been settled in a less confrontational manner, so to not put people’s lives in danger.

            If you wish to blame this on a President, then use President Clinton.

          I have seen exaggeration on both sides.

          If Mr. Bundy was “defending the people”, he would be doing it on more than just a single personal issue.

          I believe that the situation could have been handled better on both sides, but it is being turned into something that it isn’t.

        What people is he defending? The ranchers around him are all following the law. He is the only one refusing to pay taxes on federal land. The federal government holds title to the land in question. Mr. Bundy has been given every opportunity to produce evidence that he owns the land or has privileged grazing rights or states rights. He has been unable to do so. Our Constitution gives Congress the authority to make our laws. As Americans, we are expected to follow them. It is not up to our discretion to simply ignore those laws we don’t like or may disagree with. If we want to claim to be Americans, then we need to follow the same laws as every other American follows. Anything less and we are not defending anyone, but perpetrating criminal actions.

    Cliven Bundy is nothing more than a crook and a thief. That’s the truth. He might be a nice guy but so is the investment banker who defrauds all of your 401K. Cliven Bundy belongs in prison like Warren Jeffs and the cows need to be removed – now.

      I agree with you ,Brent, and reading Terri’s piece makes our stance easier to understand. A big question in my mind is – Did Bundy accept the allotment granted in 1994? A “yes” to that question would make Bundy’s stance even less tenable.

      You are commenting on issues you don’t understand. Mr Bundy is not a crook. Infact he is just opposite of that. He views this as a states right issue. The land rightfully belongs to the state of Nevada. He has willingly paid Clark County the same fees he would have paid the Feds. This issue is about who should government the land the State and County or the Federal Government. How does this make him a criminal?

        A bit of history:

        1) All of what is now known as the State of Nevada came under Federal control in 1848, when Mexico ceded the land to the US in the Treaty of Guadalupe Hidalgo (which ended the US-Mexican War).

        2) The Nevada Constitution, enacted in 1864, specifically surrendered the title/rights to all “unappropriate public lands” to the Federal Government. So, the land in question remained under Federal control when Nevada became a state.

        3) By Bundy’s own admission, his ancestors didn’t graze cattle in the area until the 1800s.

        In the absence of a PRE-1864 claim to the land in question (either granted to Bundy’s ancestors or purchased from someone holding a legitimate claim), Bundy doesn’t have a leg to stand on.

          yes, please verify via cancelled checks, bank transfers, paid receipts. You can’t because it is BS. I am assured by Clark County treasurer that they have not received any such funds and if they had received any, they would have been returned because Clark County know that it does NOT own the land. It is FEDERAL land.

        Edward, simply because he VIEWS it as a states’ right issue does not make it so. The states have not asked for any taxes from Mr. Bundy for the use of the land. Therefore it can be assumed that they do not feel they own the land either. I’m pretty certain that if the State of Nevada felt they were owed a million dollars in back taxes they would be more than eager to collect!

    This article had to make me laugh. Not that is was thoughtful and that Terri was very gracious but the glaring fact that Bundy is indeed breaking the law and a local assemblyman who is his neighbor wants our vote so he can become a congressman when he cannot even negotiate a resolution to this issue with his neighbor. It is ironic. And a sad commentary on our local politicians.

        Lorin, how long the Bundy family has been there is not the issue. Whether or not Mr. Bundy has privileged grazing rights or states’ rights is. Mr. Bundy has been given every opportunity to provide proof that he has those rights. He has not done so. The BLM has done nothing that was not sanctioned by the courts. And in all fairness, letting him slide for 20 years goes BEYOND what actions should have been taken before now! He is breaking the law. And as such is committing a criminal act. He is no different or more privileged than anyone else. He needs to pay the government what he owes them and if he does not want to pay further taxes, then he needs to remove his cattle. Period.

    There was recently an article on LTN about women and suggested there is a war on women is the US by Republicans. The recent Republican Personhood movement that wants to arrest pregnant women if the woman is suspected on harming a fetus by diet, exercise, drugs or anything else should be a wakeup call to us in Mesquite. Our local elected assemblyman, a Republican with strong religious convictions might consider supporting the Personhood movement and arresting women while totally ignoring his male neighbor, Cliven Bundy, who has stolen hundreds of thousands of dollars from taxpayers. Double standard? War on Women? Hypocrite? Make your vote count when the time comes.

      Becky, in refering to D&C 88:35-39, thou shalt not….if my information from a very devout and active LDS member is correct, the book of D&C refers to the interaction of LDS with LDS – the “brothers and sisters” as they are referred to amongst themselves – NOT in their interactions with Gentiles. This allows them a clear conscience when dealing with their own; otherwise it is of no consequence when dealing with others outside of their belief system. This explains a lot about the actions of the Hafens, Jensens, and Bundys – they take care of their own, only. Hence the desire to keep all others outside of “their rightful” territories.

      And thanks to all of you who remain sensible and articulate in your comments and are able to back them up with facts, not just bizarre opinions.

      Lorin, please use spellcheck and braincheck too, while you’re at it. Telling people to go back to where they came from is totally pointless. We all have, and should appreciate the privilege and freedom to come and go (within the law) where we please. My ancestors came here in the 1600’s – does that make me eligible to tell anyone who came after to go back to where they came from? I think the only ones with that right are the Native Americans.

        Virginia, just like their are many interpretations of the constitution, there are also many interpretations of scripture and I have learned in my years as a member of the Mormon church that just because someone goes to church every Sunday and thinks they are devote doesn’t mean they learned anything. Your devout Mormon friend either doesn’t exist or is ignorant. People of all walks of life make mistakes and do bad things so therefore we should judge an entire religion, race, culture because of a few bad apples?

Arrest Cliven Bundy. The Mormon Church does not have any legal jurisdiction over Cliven. Please tell me what you expect Cliven’s church leaders to do. Cliven has dug in his heels and won’t listen to anyone. Some of you apparently don’t like Cresent Hardy and think that because Cliven is his neighbor that he should do something. What is Cresent supposed to do when Cliven won’t budge?

      I agree that Cliven broke the law and needs to remove his cattle but the name calling and blaming others and throwing other people under the bus without having any proof is uncalled for.     It is easy to say Mr Bundy is a crook. But the federal government stole the land when Nevada became a state. Look at the constitution, the federal government is not to own land that is more than 10 square miles within the states. When a state becomes part of the union the land is supposed to be turned over to the state to do what the people of that state deem. It is very simple, the land that Bundy runs cattle on is state and county land not federal land. He has paid Clark County AUM’s for each cattle for the last 19 years. Not to mention that the family has run cattle in this area since the 1800.

      Your selective reading of the US Constitution will not fly here. The clause you discuss regarding ten square miles is in reference to the “District” as in the District of Columbia (Washington DC). Your foolish claim that the federal government ‘stole” the land is just simply false! Agreements are made when territories of the United States apply to become states (enabling acts) and both parties agree to them. You are now trying to have the State of Nevada somehow “unagree” to the agreement that was made. Your foolish and selfish argument has been rejected several times by the legal system. Obey the law or pay the price for not doing so like everyone else. Your family history and religious practices do NOT exempt you from the law.

          Ok, I reread it and looked at what the original founder said: http://teachingamericanhistory.org/library/document/federalist-no-43/ It does look like the State could agree to give their land to the Feds though it is vague in that military post were what seems to be in mind. If Nevada was dumb enough to elect those who would give the state away, so be it until otherwise decided. An analysis of the lease agreements and if the land was owned/occupied by the family BEFORE the State took it would be interesting.

            The land was granted to the United States as federal territory by the govt of Mexico as an outcoe of the war. It was never owned by the State of Nevada. When the territory applied for statehood they agreed to leave the land in the hands of the Feds. At the time, territories were allowed to reserve for themselves 2 sections of land per township to be in trust and to be used by the States to fund schools and other vital services for their citizens – Nevada DID NOT WANT the trust lands and thus DID NOT even keep control of that amount of land. Land leases for grazing are typcally for one year at a time and can be cancelled if the “manager” of the federal land determines that it wants to change the terms because of overgrazing, protection of native species, etc. That is the job of the BLM, and they have the right (and the obligation) to do so. The land in quastion was NEVER owned by the State of Nevada nor by Clark County.

      You are wrong about the Constitution. The ten square mile restriction you refer to is in Section 8 of Article 1, and it is referring to the size of the District of Columbia. There is no restriction to how much land the federal government can own in the constituent states.

      The federal government did not steal the land. Try doing some research before repeating RW rhetoric. Bundy’s decision to use federally funded resources such as grass and water to feed his cattle without paying his fair share is no different than the “welfare moochers” conservatives often complain about. He’s using federal resources even though he doesn’t meet the requirements to access those resources.

    Edwards argument that the federal government “stole the land” is ridiculous. The Nevada constitution fully recognizes the power of the federal government.

    Had he or Bundy taken two minutes to read the Nevada constitution he would have found that “no power exists in the people to subvert, or resist the Supreme Authority of the government of the United States.”

    Certainly that does not deny an individual from questioning and appealing federal actions in a court of law but once resolved the law should prevail.

    Where do these people like Bundy and Edward come up with these ridiculous assumptions.

    But they are not the only ones. Councilman Kraig Hafen, First Counselor in the Mesquite LDS Stake Presidency,
    has said more then once that the government cannot tell business what to do. As a result cattle unlawfully roam public land, homes are built on methane producing garbage dumps, money is thrown away on phony tax exempt businesses and nearly a million dollars may be spent on a needless splash pad on Hafen park.

        You can do something about it Lorin. In the courts, through legal proceedings. When you want to take it into your own hands, and promote violence then you are breaking the law. Bundy has been to court more than once. The courts decided against him every time. That SHOULD have been the end of it. But because he is stubborn and wants what he wants when he wants it with no regard to what is legally right or wrong, he continues to defy the laws. He is a criminal. Plain and simple.

      In the latest round of court action, Bundy specifically argued that the Nevada Constitution (specifically, the Disclaimer Clause by which unappropriate public lands were left under Federal control) carried no legal weight.

      I’m not kidding – go read the court order.

      So, when he talks to the media, Bundy says “I obey all state laws”…but then in court Bundy argues that State law doesn’t apply to him.

      Riiiiiiiiiiiiiiiiiiiiiiiiight.

    From the pictures I saw the tortoise is fine. The mans family has used that land for 150 years probably longer than Nevada has had a constitution. The trouble with this situation is the government knows that the American people will not stick together. You know, divide and conquer so to speak. What needs to happen is thousands of you good citizens drive down that road and back that family up. Tell those wanna be Rambos to take their guns an stick them where the sun don’t shine.Those guys would jump at the chance to shoot someone in the back just like they did to Randy Weaver’s family.       It kinda looks like both sides are a bit too trigger happy, so everyone needs to CALM DOWN! Lives are at risk over cattle grazing. To be wise, Bundy should keep his cattle on his own land (to which he hold title) and let the dust settle until all this can be settled in court. Otherwise, no good will come of it the way things are going now. Pressure cookers explode.

        This man and his ancestors have has been using this land since 1877. During that period of time he and his family have made improvements to that land like watering stations with water piped into them. I guess you would call these improvements monuments so to speak. I am almost positive that adverse possession is legal in Nevada which is as legal as a deed I’m sure even in Nevada. I think the Bundy’s are right in every thing they are doing. They have my backing 100% and everyone that I know or associate with thinks the same as me. If the Feds have people who think like you and never disagree they will never have any trouble competing Agenda 21. I guess what really bothers everyone that I’ve talked to is how the Feds went about this. This is still the USA and that just doesn’t happen here, but it did and it needs to be stopped now before it goes any further.

Your prerogative. It’s my prerogative to have a different opinion; which I do. How the Feds “went about this” was to attempt to remedy the situation through the court system. Legally. For many years. Mr. Bundy’s refusal to recognize the court’s decision and follow the law is what caused the recent situation. You are correct in that this IS still the USA, and our citizens are expected to follow our laws or pay the consequences. You don’t get to decide which laws you WANT to follow and which you do not. It’s people who think they can who have no respect for our Constitution or our country, Mr. King.

    I reread the constitution and the Federalist 43 commentary on this and retract my statement. See my other comment farther up. However, this situation is an alarming trend. I have seen the Endangered Species Act morph into an abusive blunt instrument to destroy ranches and industries. Such was done with the Spotted Owl scare which environmental extremists used to destroy CA lumber industry, false Salmon rescue in an attempt to destroy dams in Klamoth County and the Delta Smelt fiasco that is destroying farming by cheating farmers out of water that they paid for.     PS It recently came out the spotted owls were not threatened— they were cross breeding themselves with other owls thus diluting their gene pool naturally. Too bad so sad for all those who lost their land and jobs!

      Holly – thanks for your willingness to do additional research when it is called for – that is a rare and admirable quality. The use of public lands by private for-profit industries always require diligence and balance. I will not pretend to know all of the science and/or factual circumstances in every instance where the BLM management policies conflict with the wants of private industries, but whenever I do dig into a particular situation, the BLM/governing authorities usually have pretty specific and complex studies that drive their decisions. Are the scientists always right – NOPE. But I like to follow a philosophy of caution. Better to be cautious if there is reasonable evidence of harm occurring to our national lands than wipe out other species so a lumber conglomerate or law breaking rancher can make a few extra dollars in their personal pockets. FYI – EVERY single time I have researched Bundy’s claims based on the “constitution”, he has been dead wrong!

      In the latest round of court action, Bundy specifically argued that BLM was wrongfully basing its authority on the Endangered Species Act instead of the general point of trespass. The court specifically rejected that argument.

The basis on which he made his court appeal claimed that the Desert Tortoise in not protected by the ESA was that in the “definitions” section of the ESA it defines what “international trade” means and then tries to make the case that because the Desert Tortoise is not traded internationally the ESA doesn’t have jurisdiction? Maybe he needs to look up the definition of “definitions”! I don’t really think he is that stupid, but just grasps at anything he could to try to keep the law from being enforced. Real American? Honest Rancher? Give me a break.

    What kind of father would endanger his family by starting a range war.

    What kind of a rancher would overgraze on public land?

    What kind of man would steal 1.8 million dollars in forage from the taxpayers.

    What kind of a man would undercut his competitors by feeding his livestock with free feed where others have to pay for the stuff.

    Let’s stop this nonsense about Bundy being a decent citizen. He is not. He is simply trying to avoid paying 1.8 million dollars to the government and he is willing to risk the lives of his family doing so.

    This whole situation is window dressing to the real questions. This is a range war between Sen.Harry Reid and his son Rory and Cliven Bundy and his son Ryan. Harry and Rory,has conspired with a Chinese Energy company,to put a 5 billion dollar solar farm on this public land,conspired with Clark County official to sell the land at well below market value. Harry Reid has misused the federal agencies to force trumped up controversy to play to public opinion. Mr. Bundy,is old enough to remember a simular federal land grab,in a small New Mexico town,another rancher stood up to the Feds,who were taking his land for an air base fly over zone.
    We called him Grandpa Prather.The story inspired the movie,”Fire on the Mountain”. Withholding grazing fees,is about leverage for the common man.When a government goes rogue and tyrannical as ours has in the last few decades,the common man has to act to expose the real intentions of the opposing force.This is a land grab for personnel gain by a sitting senator and speaker of the house and his son. This is a grand example of why we need smaller government. These spin off federal departments take on a life of their own.Creating laws that only serve to give themselves power over their employers.         I wish Bundy well, but he appears to be the land grabber when he uses Federal land for his own purposes. Many ranchers are taken the liberty to poach our wildlife, using tortuous leg traps to kill wolves in a slow death, not to mention picking off coyotes, cougars and bears. Our wildlife is part of the beauty of America, and the prey animals are seriously on the decline in many areas of the wilderness. I’d rather see a pack of wolves than a herd of cattle.

    I remind all that everything Hitler did was “legal”. No where in the Constitution is the federal gov alowed to own state land: other than for fed offices, Military bases and Fed Monuments.       I see both sides using a lot of powerful and hateful words and I am curious if they are truly applicable or just over exaggeration.

      What “tyranny” was involved in this incident? I saw a bit of excessive force which I feel is wrong. I saw a “1st Amendment Area” which was NOT illegal.

      While I do not like the idea of a “1st Amendment Area”, it is legal and justified in some cases. If someone is going to protest the existence of a justified “1st Amendment Area”, they should protest the existence of EVERY justified “1st Amendment Area”. Not just the ones that are set up for issues that they agree with.

      This situation with Mr. Bundy and the other ranchers started before 1991. Has there really been a conspiracy to build a Chinese solar plant since then?       Why do people keep posting this Article? Research it a bit.

      What the article is stating is that the Federal Government has exclusive authority over the District of Columbia (10 sq mile).

      If you continue to read, it also gives the Federal Government the right to exercise “like authority” over “all Places” purchased by the consent of the state.

      Part one of the statement allows for the establishment of a specific Federal Area that is NOT part of any States.

      Part two give the Federal Government exclusive Authority over any areas that they purchase from the individual States.

      If you are using this as your argument, then you are fighting AGAINST the Constitution not FOR the Constitution.

          The US acquired the land from Mexico, before Nevada and the Utah territory were even a glint in your Great, Great, Granddaddy’s eye. In the granting of statehood, the state fathers agreed that a large portion of the state would remain as the property of the USA. Gold Butte was never state property, even though, it is in the State of Nevada. Bundy has his head crammed where the sun don’t Shine.

          “…the people of Nevada to form a constitution….do agree and declare, that they forever disclaim all right and title to the unappropriated public lands lying within said territory, and that the same shall be and remain at the sole and entire disposition of the United States;”

          ONE MORE TIME – The USA was deeded the land after the Mex/Amer war. Then when Nevada became a state the land, as shown in the constitution, “remained at the sole and entire disposition of the US”. I think that pretty well constitutes the “Consent of the legislature”! Don’t you? Why do we have to keep stating these FACTS? There is no “foundation to stand on”.

          While I would understand your original post in regards to Federal Authority over land (it is a common confusion), you are shifting your argue a bit too far in my opinion.

          Arguing against the Federal Government owning vast tracks of land in western states is one thing, arguing that no one has property rights to any land in the United States is an entirely different matter.

    In the situation involving Cliven Bundy, fully armedforce was sent in to “round up” his “trespass” cattle because of his failure to remove them from lands his family has used since the 1870’s. Illegal aliens cross our borders everyday and border gaurds are instructed to not use their weapons but to run and hide to avoid confrontation. Their were several other options open to the BLM including liens on bundy’s accounts, the sale of his cattle etc., but no, they chose to use a show of force. All across the country there are instances where police and the alphabet agencies are using undue force on American citizens on an increasing regular basis. Is this not tyranny?
